Class Actions & MDL
Practice Group

Klein Thomas Lee & Fresard’s Class Action & MDL Practice Group represents some of the world’s largest corporations in class action and MDL proceedings in courts throughout the country. We have extensive experience advising our clients through all stages of class action litigation, from pre-suit notice, through class certification, and trial. Our attorneys are known for developing cutting-edge arguments based on the most recent case law to defeat class actions and to manage issues related to unfavorable forums.

KTLF attorneys have defeated class certification based on claims of economic injury by purchasers of allegedly defective goods, structured favorable settlements that gained court approval, and prevailed at trial in a certified class of vehicle owners alleging that an automotive manufacturer violated California’s Consumer Legal Remedies Act.

Substantive Experience
We have a proven track record of success in opposing class certification in federal courts throughout the country, including the Eastern District of California and the Southern District of Florida. We have broad experience in defending against class actions based on state consumer protection claims and allegations of fraudulent conduct.

Proven Results
Few attorneys have taken certified classes to trial. Ours have. KTLF’s class action defense team combines our attorneys’ experience in complex briefing and analysis with our passion and skill in the courtroom. We have defeated class certification in numerous cases, and have substantial experience litigating consumer protection claims on the merits, in the event that a court grants class certification.

Strategic Case Management
We always place our client’s best interest first. Sometimes that means knowing when to recommend settlement of an action. We have broad experience counseling clients through class action settlement, including moving for, and receiving, court approval of the settlement, surviving objectors’ collateral attacks on the settlement, and maximizing the scope of the settlement to create a predictable long-term resolution of the matter underlying the litigation for our client.
