Klein Thomas Lee & Fresard’s Appellate and Advanced Motions Practice Group represents clients in the U.S. Supreme Court, federal courts of appeals, and state appellate courts. Our appellate lawyers also work closely with the firm’s trial attorneys to prepare novel claims and defenses, navigate difficult legal issues, and handle complex motions at all stages of litigation. The team members, who include former law clerks from federal and state courts across the country, use their diverse range of experiences to help clients prepare and pursue long-term appellate strategies to solve their most difficult legal challenges.

Our appellate team has handled civil and criminal appeals on a range of topics, including constitutional rights, product liability, class actions, administrative law, employment law, contract disputes, copyright protections, and business torts, among other areas. No matter the subject, we thrive at distilling complex issues into clear, powerful arguments.

All appellate proceedings
The firm’s appellate practice is not limited to defending important wins or attacking dangerous losses after a final judgment. We also help clients with emergency stays pending appeal, writs of mandamus, and review of orders granting class-action certification. The team also has substantial experience drafting amicus briefs, petitions for rehearing, and petitions for a writ of certiorari.

Collaborating with trial teams
The firm’s appellate lawyers work closely with our trial attorneys to anticipate, identify, and preserve issues for appeal. We routinely draft significant pre- and post-trial motions, including Daubert motions and motions for summary judgment. Many clients rely on our appellate team for big-picture strategic advice in the trial courts, such as navigating multijurisdictional disputes and planning for litigation after a rulemaking.
